摘要:	在行政體系的研究構思與立法委員的腦力激盪下，問世較晚的我國《遊說法》照理應較其他民主國家的立法更為完備。但誠如前文所述，遊說主客體與活動內涵的曖昧性，已使得此一法律的執行能力，必須仰賴於其他社會環境或文化歷史因素。例如，國人的守法習慣、政治活動的透明性、監督制衡機制的有無、人民團體的活躍性、政治領袖的認知、選舉活動的秩序、公務員的操守、司法的獨立、民意的表達等等。故而，他國失敗與成功的經驗，對後發的我國，並不必然就可以完全抄襲。有鑑於此，立法院在三讀通過《遊說法》時，便曾作成附帶決議，主張在該法施行後半年，必須針對其執行成效進行檢討，以供修法之參考。此一附帶決議的精神，完全符合先進國家實施遊說法的經驗，因為在複雜的主客觀因素下，法的成功實施，只能有賴於不斷的嘗試與修正。雖然其他國家的實施經驗、學者的理性分析、以及立法者的論述，仍具有相當的參考價值，但更縝密的比較研究則不可省卻。我國《遊說法》實施迄今已達半年，各項問題應已逐漸浮現，本研究便希望針對法的實施狀況，進行廣泛性與比較性的研究，以做為決策單位與立法機關的修法參考。 Taiwan has been applying Lobbying Law for more than two years. During the two years period, the effectiveness of the Law was seriously questioned. The media, in particular, carried many negative stories on the enforcement of the Law. Lobbying Law is different from other public law, its effectiveness requires high cooperation from the ones regulated by the Law. Yet, it takes time for a society to develop cooperative attitude toward the Law. As such, few countries are proud to claim that they are successful in enforcing Lobbying Law. Obviously, there are problems involved in the design and enforcement of Taiwan’s Lobbying Law. The Law has promulgated for more than 2 years, yet none of a profit organization has ever registered under the Law as a lobbying group. Anyone making a quick glimpse of daily newspaper can easily detect reports on lobbying activities, but few of those involved had registered as lobbyists. According to the Law, each government institution must develop a “special zone for lobbying information” on its webpage. Yet, many institutions choose to ignore the requirement. These observations show that Taiwan’s Lobbying Law do have some defects need to be amended. The lawmakers never perceive the Law as a perfect design. On approving the Law, they attached a resolution requiring the Law reviewed after its enforcement. This research project, “the Study of the Effectiveness of Taiwan’s Lobbying Law,” is conducted as part of the review process. The researcher will interview specialists, lobbyists, and government administrators to evaluate the effectiveness of the Law. It is hoped that the research result will provide a foundation for lawmakers to ponder the revision of the Law.
