Abstract
The goal of this thesis is to make framework combination of liability and damage on tort liability between Taiwan and China law. The first chapter introduces the motive, method and goal of this thesis. The second chapter analyzes the subjective and objective elements of tort liability under Taiwan Law and further explores the damage compensation of tort liability in terms of scope, method, liability subject, lapse of time and so on.
The third chapter discusses the content and damage compensation of general provisions of the civil law in China and then explores the goal of legislation, liability rule and damage compensate of tort liability law passed in the end of 2009.
The fourth chapter emphasizes on the research regarding the comparison of general ideas of tort liability rule and damage compensation system currently between Taiwan Strait and suggests the most important points for improvement which could be served as the reference for the revision or legislation of related laws on tort liability under Taiwan in the future.
