Abstract:	中文摘要本篇論文主要係在於將台灣一般侵權行為責任與中國侵權責任法之侵權與損害賠償現行制度作一架構整合。第一章係撰寫本文之研究動機、方法、目的等。第二章從台灣普通法民法一般侵權行為責任之主、客觀要件一一分析，進而探討侵權行為之損害賠償，從其損害賠償範圍、方法、人之標準、消滅時效等方面論述。第三章係探討中國民法通則就侵權行為責任所為之規定，及其損害賠償，其後就中國於2009年底通過之侵權責任法之立法意旨、歸責原則及損害賠償之研究。第四章則著重在兩岸間現行一般侵權行為責任與損害賠償制度比較評估研究，並提供建議改善要務，作為台灣侵權行為責任相關法規未來修正建議及立法之參考。 Abstract The goal of this thesis is to make framework combination of liability and damage on tort liability between Taiwan and China law. The first chapter introduces the motive, method and goal of this thesis. The second chapter analyzes the subjective and objective elements of tort liability under Taiwan Law and further explores the damage compensation of tort liability in terms of scope, method, liability subject, lapse of time and so on. The third chapter discusses the content and damage compensation of general provisions of the civil law in China and then explores the goal of legislation, liability rule and damage compensate of tort liability law passed in the end of 2009. The fourth chapter emphasizes on the research regarding the comparison of general ideas of tort liability rule and damage compensation system currently between Taiwan Strait and suggests the most important points for improvement which could be served as the reference for the revision or legislation of related laws on tort liability under Taiwan in the future.
