    Abstract: 原住民族權利的法制化來自原住民族運動後爭取的結果,而原住民族運動的產生則來自原住民族挑戰國家權力行使、反殖民侵害的一個過程。隨著原住民族運動而生的原住民族基本法對台灣人權發展與原住民族尊重都是極大進步,其中原住民族基本法第21條諮商同意權,乃是落實原住民族自決權的展現。
    本研究從德卡倫部落會議踐行諮商同意實務案例經驗分別闡述諮商同意權落實於部落的現況,並整理諮商取得原住民族部落同意參與辦法現有的缺漏,再透由近期追蹤原住民族委員會修法討論及法院判決案例探討修法爭議,試著提出相關修法建議與實務實踐層面的可行方向。
    The legalization of indigenous peoples' rights in Taiwan results from the struggles of the indigenous movements, which arose as indigenous peoples challenged the exercise of state power and resisted colonial encroachments. The Indigenous Peoples Basic Law, born alongside the indigenous movements, represents a significant advancement in Taiwan's human rights development and respect for indigenous peoples. Article 21 of the Indigenous Peoples Basic Law, which grants the right to consultation and consent, is a manifestation of the realization of indigenous peoples' right to self-determination.
    This study examines the implementation of the right to consultation and consent within indigenous communities, specifically using practical cases from the Rgayung tribl meetings.It identifies existing gaps in the methods for obtaining indigenous community consent and participation. Furthermore, the study follows recent discussions on amendments by the Council of Indigenous Peoples and court rulings to explore controversies around the proposed amendments. The aim is to propose relevant amendments and feasible directions for practical implementation.
