摘要: | 工會是一個透過團結一群在同一廠場/企業、產業或是職業內勞工的法人組織,通常運用集體協商、勞資爭議協商或其他集體行為等方法來替勞工維護勞動權益,達到提升他們的工作待遇與生活品質之目的。本研究主要會從文獻探討、歷史研究以及深度訪談來歸納出臺灣工會在替護理人員維護勞動權益時所運用方法中的想法、過程、困境、影響及成效,並且探討在勞資政社會對話基礎上臺灣工會的樣貌。首先,從相關文獻中探討到臺灣護理人員在適用於勞動基準法後身份轉換過程、整體護理人力資源概況與發展、在醫院職場環境中所面臨的問題以及護理產業的工會發展。接著,從深度訪談和歷史研究中發現到,台灣護師醫療產業工會集眾人之力維護自身勞動權益,讓護理產業不再是很小而是招不到人,以及展現出團隊作戰的精神。再者,從深度訪談和歷史研究中發現到,國立臺灣大學醫學院附設醫院企業工會以基層護理人員微薄之力去維護全醫院員工的勞動權益,讓所有人都可以享有到對等的專業價值和報酬。最後,從這兩個案工會中歸納出工會透過勞工教育發展職能以及團結基層勞工的力量促進合作均能展現出在維護勞動權益上不可被取代的重要性,並積極扮演好促進職場和社會進步以及身為資方與勞方之間橋樑的角色。
A labor union is a legal organization that unites a group of workers in the same factory/enterprise, industry, or occupation. It usually employs different methods such as collective negotiation, labor dispute negotiation or other collective actions to safeguard labor rights and interests representing workers to the purpose of promoting their working conditions and quality of life. This study mainly summarizes the ideas, processes, dilemmas, influences, and effectiveness of the methods used by Taiwanese labor unions in safeguarding labor rights and interests for nursing professionals from literature review, historical research, and in-depth interview, and explore the basis of social dialogue what a union looks like in Taiwan. First, from relevant literature, the status transfer process of Taiwanese nursing professionals after the application of the Labor Standards Act, the overview and development of overall nursing human resources, the problems faced in the hospital workplace environment, and the development of labor unions in the nursing industry are discussed. Then, from in-depth interviews and historical research, it finds that the Taiwan Nursing & Medical Industries Union (TNMIU) mobilized every worker to safeguard their own labor rights and interests, so that the nursing industry is no longer small but unable to recruit people and demonstrates the spirit of teamwork. Furthermore, from in-depth interviews and historical research, it finds that the National Taiwan University College of Medicine Affiliated Hospital Union (NTUHU) uses its micro efforts of common nursing professionals to protect the labor rights and interests of all hospital employees, so that they can have equal professional value and compensation. Finally, from these two case labor unions, it can be concluded that a labor union through the labor education to develop the functions and uniting the power of common workers to progress the cooperation can demonstrate its irreplaceable importance in safeguarding labor rights and interests, and actively playing a role in promoting the workplace and society to have the progress and as the bridge between employer and labor. |
