    Abstract: 隨著網路與人類社會愈發緊密,任何事情都可能透過網路進行,其中也包含了在網路上實施惡意的攻擊行為,一般將此一新型態的偏差行為,稱之為「網路霸凌」。鑑於網路的迅速發展,令使用者隨時隨地都能利用網路從事類此惡意行為,促使網路霸凌成為最熱門的話題之一。由於網路的特性,以及網路霸凌與傳統霸凌本質上存在著差異,致使網路霸凌被害者較傳統霸凌被害者更難以獲得協助,成為當代難以解決的人際關係問題。有鑒於此,近年來多有呼籲管制類此不當的網路行為聲浪,希冀透過法制規範保障網路使用者的權益,同時也維護網路使用環境的安全。
    網路霸凌除了屬於單純的反社會行為外,部分的網路霸凌行為也涉及了犯罪。本篇論文將常見的網路霸凌,以各網路霸凌行為所侵害之法益類型作為分類,分別探討其所涉犯之犯罪,進一步反思現行法不足以評價網路霸凌行為之處。此外,鑒於網路霸凌事件之頻傳,防治網路霸凌工作至關重要,然而透過定立專法、實施網路實名制之法,又有箝制言論自由之可能,因此本篇論文試就防治網路霸凌提出建議,期能有效地於事前降低網路霸凌事件,事後提供網路霸凌被害人協助管道。
    As the Internet and human society become more and more closely connected, anything can be done through the Internet, which also includes malicious attacks on the Internet. Generally, this new type of deviant behavior is called "Cyberbullying." With the rapid development of the Internet, the Internet can be used to engage in such malicious acts anytime and anywhere, cyberbullying become a popular issue. Due to the characteristics of the Internet and the differences between cyberbullying and traditional bullying, victims of cyberbullying are more difficult to ask others for help than victims of traditional bullying.
    In addition to being an anti-social behavior, cyberbullying also involves crimes. This article classifies common cyberbullying behavior by the types of legal interest, discusses the crimes involving, and review the deficiencies of the current law. Additionally, in view of the frequent spread of cyberbullying incidents, the prevention and control of cyberbullying is more importance. However, enacting an anti-cyberbullying act or a real-name policy may suppress freedom of speech. Therefore, this article will propose policy about prevent cyberbullying, hoping reduce cyberbullying incidents, and provide a remedy for the victim of cyberbullying.
