摘要: | 本研究旨在研究同志於司法院釋字第七四八號解釋施行法立法歷程中,即臺灣同性婚姻專法的立法歷程,同志在面對職場性傾向歧視的經驗,以及面對性傾向歧視所採取的因應方式。本研究採取質性研究,並以立意取樣及滾雪球取樣招募6位研究參與者,以半結構式訪談進行一次約60至90分鐘的訪談。文本資料的分析採用主題分析法進行分析與歸納,得到研究結果如下:
「職場性傾向歧視轉以微歧視方式,面對歧視的感受差異甚大」,在立法歷程中,職場中檯面上對於性傾向的歧視逐漸減少,或是以「微歧視」的方式展現,而研究參與者在感覺職場逐漸變得友善之餘,仍能感受到一些歧視的存在,面對職場性傾向歧視的感受差異,來自於個體內在狀態的不同,除影響感受外,也影響了面對性傾向歧視的經驗。
「對自我性傾向的接納,影響面對性傾向歧視的因應方式」,研究發現立法歷程不僅僅是權益之爭取,還有消除歧視及汙名,讓同志對自己的性傾向能有正確的了解,消除內化恐同及增加自我認同,隨著對性傾向的認識增加,以及感受到支持者的表態,促使研究參與者勇於表態,面對歧視所採取的因應方式也變得更為接納自身性傾向,減少為滿足異性戀霸權結構的因應方式。
「立法帶來震盪的影響,法案實施促進友善環境」,立法歷程中的公投事件給同志帶來強烈的痛苦、挫折及負面感受等,造成生活及職場上的負面影響,嚴重影響同志的心理健康,在同性婚姻專法實施後,整體社會氛圍變得更加友善,職場上產生友善的變化,而社會上仍有對存在同志的敵意,顯示職場上的歧視狀況減少或減輕,但歧視狀況仍然存在。
The purpose of this research is to study the experience of gays in the face of sexual orientation discrimination in the workplace and the ways they deal with the discrimination during the legislative process of the Interpretation and Implementation Law of Interpretation No. 748 of the Judicial Yuan, which is the legislative process of Taiwan's same-sex marriage special law. This is a qualitative research and six participants are recruited by purposive sampling and snowball sampling. Semi-structured interviews are conducted with a duration of approximately 60 to 90 minutes. The analysis of the text data adopts thematic analysis and the research results are as follows:
"Sexual orientation discrimination in the workplace has shifted to the form of micro-discrimination, and the perception of discrimination is very different." During the legislative process, sexual orientation discrimination in the workplace has gradually decreased, or it has been manifested in the form of "micro-discrimination". While the participants feel that the workplace has gradually become friendly, they can still feel the sexual orientation discrimination. The difference in their feelings of discrimination comes from the difference in the individual's internal state, which not only affects the feeling, but also affects experiences of facing sexual orientation discrimination.
"Acceptance of one's own sexual orientation affects the way deal with the sexual orientation discrimination." The research found that the legislative process is not only a struggle for rights, but also the elimination of discrimination and stigma, make gays have a correct understanding of their sexual orientation, eliminate internalized homophobia and increase self-identity. With the increase of awareness of sexual orientation, and the perception of supporters' opinions, the participants are encouraged to express their opinions, and their coping methods in facing of discrimination have become more accepting of their own sexual orientation, reducing coping styles to satisfy heterosexual hegemonic structures.
"Legislation has a shocking impact, and the implementation of the same-sex marriage promotes a friendly environment." The referendum during the legislative process has brought intense pain, setbacks and negative feelings to gays, causing negative impacts on life and work, and seriously affecting gays' mental health. After the implementation of the same-sex marriage, the overall social attitude has become more friendly, and there have been friendly changes in the workplace. However, there is still hostility to LGBT people in the society, indicating that the discrimination in the workplace has been reduced or alleviated, but discrimination still exists. |
