    摘要: 本研究就2019年8月26日中國大陸修訂《中華人民共和國土地管理法》,其中將農村集體經營性建設用地可以直接入市這一項重大突破性改革作為研究對象。運用相關理論,分析明確的產權對中國大陸處理土地增值分配的重要性。并將浙江省義烏市「八街六鎮」作爲研究區域,利用義烏市國土資源局提供之入市數據,構建博弈理論Shapley Value模型,對參與主體分配比例進行具體數值測算,基於測算結果,檢討義烏市試點現行之增益分配比例,提出入市改革的建議和相關對策。土地制度直接影響農民與土地直接權利;農村集體產權不明確,存在混淆或弱化農民自主產權意識;入市區塊秉承「初次分配基於產權」原則,難以落實。其次,入市區塊增益形成因素涉及土地性質、開發成本、土地所有者和使用者。其增益分配關係主要圍繞初次參與入市增益分配參與者:村集體和農民、二次分配參與者政府進行。根據實證地區浙江省義烏市以不同用地範圍、規劃用途的農村集體經營性建設用地作爲研究對象,利用 Shapley Value模型,對政府、村集體和農民測算獲得入市交易增值收益的分配比例,政府應獲得的增值比例為12%~45%,村集體應獲得增值比例為34%~61%,農民應獲得增值比例爲21%~38%。
    本研究認爲農村土地產權存在模糊,現有成果與測算結果較吻合,建議注重入市地塊規劃範圍,調整更新參與主體增值收益分配比例,制定有效的農村集體內部監管制度及土地權屬分類管理辦法。
    This research is based on revised the "Land Administration Law of the People's Republic of China" which included a major breakthrough reform that rural collective operating construction land can directly enter the land transaction market as the research object on August 26, 2019 in Mainland China, Using relevant theories, analyze the importance of clear property rights to the distribution of land value-added benefits in Mainland China. Taking the “Eight streets and six townships” in Yiwu City, Zhejiang Province as the research area, using the land transaction market data provided by Yiwu Land and Resources Bureau, the Shapley Value model of game theory was established, and the specific numerical calculation of the distribution ratio of participants was carried out based Based on the calculation results, review the current gain allocation ratio of the Yiwu pilot project, and put forward suggestions and related countermeasures for entering the land transaction market reform. The land system directly affects the direct rights of farmers and land; the rural collective property rights are not clear, which confuses or weakens the awareness of farmers' independent property rights; entering the land transaction market block adheres to the principle of "primary distribution based on property rights", which is difficult to implement. Secondly, the factors forming the gains of entering the market involve the nature of the land, development costs, land owners and users. The distribution relationship of value-added utilization mainly revolves around the distribution participants who participate in the value-added utilization of the land transaction market for the first time: village collectives and farmers, and participants in the secondary distribution: the government conducts. According to the empirical area, Yiwu City, Zhejiang Province, uses rural collective operating construction land with different land use scopes and planned uses as the research object. Using the Shapley Value model, the government, village collectives and farmers "village collective individuals" are estimated to gain value-added access to the land transaction market. As for the income distribution ratio, the government should obtain a value-added ratio of 12% to 45%, the village collective should obtain a value-added ratio of 34% to 61%, and the farmer "village collective individual" should obtain a value-added ratio of 21% to 38%.
    This study believes that the property rights of rural land are ambiguous, and the existing results are more consistent with the results of calculations. It is recommended to focus on the planning scope of land parcels entering the market, adjust and update the proportion of value-added income distribution of participants, and formulate an effective rural collective internal supervision system and land ownership classification management methods .
