| 摘要: | 勞動基準法第84條之1原為社會經濟變動，勞動條件也隨之變更，在1996年為擴大勞基法適用對的範圍而新增，但自本法新增適用後，問題慢慢浮出，勞資雙方的爭議也屢見不鮮。例如華航空服員罷工及保全人員等長期超時工作，所引發諸多疑慮與爭執，究其原因，源於目前我國實務操作下「責任制」有被資方擴大或濫用其制度，而處於弱勢的勞方在欠缺資源與成熟的集體力量很難與企業主對抗。
