    摘要: 本文深入探究有關在集會遊行不予許可中,針對不確定法律概念之判斷。首先探究觀察整體性,有關司法審查與集會遊行,論述行政判斷與行政裁量之概念等,並進一步探討行政判斷在集會遊行之適用。另對於重要不確定法律概念予以論述探討,如此探究將以利於實施行政判斷,例如國家安全、社會秩序、公共利益、危害概念、生命、身體、自由與財物等。另生命、身體、自由與財物等概念,基於深入研究,認為從法學觀點,往往應可先從憲法保障人權權益論起。然而縱使未來立法採行報備制,基於國家安全與社會治安,仍必須有所謂危害預防的有效手段。在此,本文認為路權場所之取得並非取決於集會遊行之主管機關,則無法體現集會遊行受規範而保障合法集會遊行之基本人權,故應對路權場所之取得同意文件,在集會遊行法規定,仍可授權集會遊行主管機關會同地方縣市政府訂定詳細法規命令予以實施。綜合言之,針對現行集會遊行法實施後,相關重要實務問題與修法,本文探討路權之重複與未合法團體之申請等問題,並探究配合報備制,依據行政院版本草案,探討未來修法之方向,以提供理論與實務參考。
    This article explores in depth the judgment of uncertain legal concepts in the absence of permission for assembly and demonstration. First, this article will explore the overall integrity related to judicial review, assembly, parade, and the concept of administrative judgment and administrative discretion, which will then elaborate on the application of administrative judgment in assembly and demonstration. In addition, the discussion of important uncertain legal concepts will be examined in order to facilitate the implementation of administrative judgments such as national security, social order, public interest, the concept of hazard, life, body, liberty and property. Based on a thorough research on the concepts of life, body, liberty and property from the legal perspective, a preliminary discussion on constitutional rights and interests of individuals from legal perspective is recommended. However, on the basis of national and social security, even if the future legislation adopts the reporting system, there still must be effective means to prevent harm. This paper believes that obtaining the right-of-way permit does not depend on the competent authorities, and thusit does not embody the basic human rights in terms of Assembly and Parade Act. Therefore, the consent documents of the right-of-way permitshould be stipulated in the Assembly and Parade Act. The authorities can authorize the local county and city governments to formulate and implement detailed regulations. In summary, aiming relevant issues and amendments upon the implementation of the current Assembly and Parade Act, this article puts forward the issue of obtaining duplicated right-of-way permits, applications from unlawful groups, cooperation with the reporting system, as well as providing theoretical and practical reference for future revisions on a draft version of the Executive Yuan.
