    摘要: 本論文之研究主題為「2017年勞基法工時修正之法律問題探討」,以文獻分析、案例研究與比較研究法的方式,徹底理解我國的工時法立法歷程、修法的原由與修法完成後產生的效應與變化,深入探討其對我國勞動市場帶來的影響。藉由與它國法制之比較,找出我國工時法立法時可肯認之優點,與應修正之缺點,希望本篇論文能成為我國工時法修正時,得參考之有價值文章。
    本論文之架構,分為六章:第一章的內容為緒論,將說明本文撰寫的研究動機與目的,再來是針對本文的研究範圍作界定,並說明各章節欲撰寫之內容架構。最後是說明本文採用的研究方法,以及資料的蒐集來源簡介。
    第二章會針對我國勞動基準法在舊法時期中的工作時間、休息及休假規定做詳細介紹。並藉由案例研究的方式,用實務案例來做探討,以理解我國過去在實務運作上,是如何處理有關於工時方面的爭議案件。
    第三章為工時法規範修法的介紹,我國在近兩年來,針對工時法規進行過多次的修正,本章將針對一切的修法內容及原因,進行詳盡及明確的介紹,並適時導入外國法來與我國的立法作比較。
    第四章將介紹中國的工時制度規範,並針對其中與我國相類似的立法,進行比較。中國的工時制度一直有再進步的趨勢,筆者將從中找出可供我國學習的優點,以做為未來的修法借鏡。
    第五章及為工時法之再建構意見提出,內容將針對新修法進行點評,並提出一些筆者的淺見,且會參酌前面章節內容中提到的外國法之優點,來為筆者的意見增加參考價值。
    第六章是結論,將會總結前述各章節之討論內容。著眼於對勞雇雙方都能帶來益處的修法構想,期許透過本篇論文的撰寫,能為我國未來的修法帶來一些新想法及助益。
    The research topic of this thesis is “A Study on the Law Issues of Working Hours Revision of Labor-Based Law in 2017”. By using the methods of literature analysis, case study, and comparative research, we thoroughly understand the legislative history of work-hour law in China, and the reasons for revision and the completion of amendments. After the effects and changes, the in-depth discussion of its impact on the labor market in China. By comparing with the country's legal system, we can find out the merits that can be acknowledged in the law of working hours in China and the shortcomings that should be corrected. I hope that this paper can become a useful article for reference in the revision of the working hours law in China.
    The structure of this paper is divided into six chapters: The content of the first chapter is the introduction, which will explain the research motivation and purpose of this paper. The second one is to define the research scope of this paper and explain the content structure of each chapter. The last part is to explain the research methods used in this paper and the source of data collection.
    The second chapter will give a detailed introduction to the regulations on working hours, rest and leave in the old law period in China's Labor Standards Law. Through case studies and practical case studies, we will understand how our country has dealt with cases involving man-hour disputes in the past.
    The third chapter is an introduction to the method of revision of the Working Hours Law. In the past two years, China has made several amendments to the laws on working hours. This chapter will give detailed and clear explanations on the contents and reasons of all amendments and introduce foreign laws in due course. Come compare with our country's legislation.
    Chapter four will introduce China’s working time regulations and compare them with similar legislation in China. China’s working time system has always been a trend of further progress. The author will find out the advantages that can be learned by our country and use it as a mirror for future amendments.
    Chapter five and proposed reconstructing opinions on working hours law. The content will comment on the new amendments and put forward some views of the author. He will also consider the advantages of foreign law mentioned in the previous chapters to increase the author’s opinions. Reference value.
    Chapter six is the conclusion and will summarize the discussion in the preceding chapters. Focusing on the concept of revision of law that can benefit both employers and employees, it is hoped that through the writing of this paper, we can bring some new ideas and benefits for our country's future revision.
