Abstract:	都計與區域計畫法令中，土地由低價利用變更為高價值利用所須負擔的土地變更使用開發回饋措施，各界對於課取基礎仍存有「地價增額」、「開發利潤」或「開發影響費」等爭議。本研究針對此議題，評析既有文獻之開發利得界定與分析方法，解析各種界定方式之優劣；再從規劃管制制度角度，研提土地變更使用開發利得及分析衡量式。研究認為：土地變更使用開發利得，宜為計畫提出申請至開發完成之地價增額；此階段屬規劃管制範疇，政府可利用規劃管制工具，調整公私利得分配。「土地變更使用開發利得」得定義為：「開發完成時，都市地區符合該土地條件的變更後使用分區地價，減去計畫申請變更之地價，及該地區平均地價上漲率產生的地價增額，並扣除因變更使用制度產生的成本」。 Exaction of development conversion gain was used as an attachment criterion of land use conversion in Taiwan, that also was a planning control tool to address speculation in land use up zoning. Media always raise many doubts on the definition of development conversion gain. This research reviews every kind of definition and analyzes method. From the point of planning control, this paper estabishes an analysis method and definition of development conversion gain. It suggests the definitions of development gain due to land use conversion is land price appreciation due to land use conversion then decrease the transaction cost of land use conversion.
