Abstract:	惟近來國內各項重大公共工程建設之推行，常遭遇到用地取得難以順利推展之困擾，致工程進度深受延遲，無法如期順利推展，其中「補償」問題輒為關鍵之所在，為解決此一重大問題，惟有深入探討人民財產權之保障與公用徵收補償兩者本質、內容與範圍及公用徵收之本質與要件，研析兩者調和之道，以為未來公用徵收補償制度之參考。
