本論文為同性婚姻及多元成家之沿革及展望之討論，其中討論包含家庭權的憲法地位、同性婚姻之立法沿革、外國立法例比較、法律經濟分析等議題。
本論文於第二章分析社會及法律意義上的家庭，其中包含家庭權的憲法地位，並說明家庭在現今社會面臨之變遷與挑戰。第三章部分，主要探討同性婚姻的沿革，包含同性婚姻在我國之立法及實務，並介紹同性婚姻之外國立法例，其中即包含美國紐澤西州、德國、法國等國家之立法例。
本論文第四章同性婚姻制度與伴侶制度立法草案評析部分，則係分析伴侶權益推動聯盟（伴侶盟）所提出之同性婚姻及伴侶制度草案，例如締結婚姻的自由、締結親子關係的自由、享受婚姻推定的自由，以及伴侶制度的各種要件，並尌伴侶盟所提出之修法草案逐條分析，輔以個人修法見解。第五章同性婚姻合法化之法律經濟分析，係先探討家庭在經濟上的效應，而得出應給予同性伴侶成家的機會，並接續討論同性婚姻帶來的益處。
本論文第六章結論部分，係尌前述第一章至第五章之內容做出總結，並得出應盡速修法給予同志朋友成家權利之建議。
This paper discusses about the same-sex marriage and multiple family and separates into 6 chapters; including the rights of the family, the legislative process of same-sex marriage, the foreign legislation, and
the economic analysis of law.
The first chapter is about the field of the research and method.The second chapter focuses on the rights of family, such as constitutional rights and the family changing.
The third chapter emphasize on the same-sex marriage, such as the Taiwanese legislation system and the foreign legislation system inclusive of New Jersey, Germany, and France.
The fourth chapter points out the TAPCPR’s draft legislation of same-sex marriage, multiple families and analyzes the contents of the right of marriage, the parent-child relationship and etc.
The fifth chapter is mainly about the economic analysis of law of the same-sex marriage; it explores the economic effects for the family and the benefit of the same-sex marriage.
The last chapter is the conclusion, and the summary which is based on the previous discussion, and makes a purpose of legal amendment for same-sex marriage.
