隨著網路交易日益頻繁,網路購物標錯價格事件在國內外均屢屢發生。其所涉及之法律問題主要有兩方面,一是契約是否成立問題,二是是否得以錯誤撤銷之。本文先整理我國過去發生之案例與實務見解,然後闡述外國發生之案例事實、法院見解,以及相關規範。接著則是分別就契約成立與錯誤撤銷兩大問題,深入加以探討。前者主要在於探討網路廣告之性質、契約何時成立,以及系統自動回覆之法律性質;後者則在於探討標價錯誤之類型有哪些,並從立法政策面檢討我國法規定必須無過失才可以錯誤撤銷是否適當,以及在法律適用面,應採取何種過失責任之認定標準,較為妥適。
With the increase of transactions in internet, e-commerce with false price indication has happened frequently all over the world. The main legal issues include the validity of contract and the withdrawal of contract due to false explanation. First of all, this thesis works on the practical opinions of Civil Courts in Taiwan. In addition, the development of case laws abroad has been taken examples to explain how to deal with such legal issues in other countries. Hence, this thesis focuses on the legal comparison under the aspects of advertisement in internet, valid timing of contract and criterions of faults. Finally, a conclusion has been drawn how it is suitable to deal with above mentioned legal issues.
