都市更新主要係由所有權人、實施者與規劃團隊依都市更新條例及相關法令互動而成,在前述參與者間由於立場、認知的不同常產生「衝突」,都市更新案件的成功有賴於化解全體參與者之衝突進而取得共識。依都市更新條例規定,都市更新得以權利變換、協議合建、信託、徵收等方式實施都市更新事業,然不管以哪一種方式實施都市更新事業,仍脫離不了「整合」的範疇,有必要探討整合之課題與對策。本研究擬透過衝突管理及都市更新整合等相關文獻回顧,分析都市更新法令政策方向及實施現況相關問題,探討實施成效不佳背後的原因,同時以台北市北投區都市更新案為案例探討後,藉由半結構式訪談及其結果分析,嘗試提出課題,並回顧衝突管理理論擬議因應對策,以達成預期的研究目的。
Urban renewal can be viewed as an interaction among property owners, the implementer, and the planning team under urban renewal provisions and relevant laws and acts. Conflicts often arise because of these participants’ different stances and viewpoints, and therefore, the success of urban renewal projects is heavily dependent upon resolving conflicts and reaching consensus. It is stipulated by the Urban Renewal Act that urban renewal can be carried out by exchange of property rights, co-construction, urban renewal trust, and expropriation. Because integration is involved in all of these measures, it is important for researchers to examine integration-related issues and strategies. The study conducted a literature review of conflict management and urban renewal integration and analyzed the essence of urban renewal legislation, policy direction, and current state of implementation to discover reasons for poor urban renewal implementation. The investigator also chose the urban renewal project of Beitou District of Taipei City to conduct semi-structured interviews. After an analysis of the interview results, the investigator picked some important issues that require attention. In accordance with the objectives of the study, the investigator also reviewed conflict management theory and proposed corresponding strategies.
