中草藥為我中華民族祖先遺留給我們最珍貴的遺產，因應時代的進步，中草藥運用生物技術之方法來生產製造，除增加中草藥之有效成份，亦可使其有效成份之機制更加明確。世界各先進國家亦積極投入中草藥開發，隨海峽兩岸進入WTO進。如何使開發的成果獲得專利，並以專利法律保護我們研發之成果，進而與世界接軌，瞭解歐美及國際公約在智慧財產權對中草藥生物科技之保護，即為本文研究之重點，藉此希望能對投入中草藥開發的業者，能有所幫助。
Chinese Medicine left behind by Chinese ancestors gives us a most precious inheritance. In the present day, the method of manufacturing Chinese medicine utilize biological technology which can increase production, also will active principle of production of the medicine. Biotechnology will also increase the explicit of the medicine. So many other developed countries are doing research into Chinese medicine. Along with the two sides across the Taiwan Strait are members of WTO, To understands Europe and America and the international joint pledge in the wisdom property rights to protection the Chinese medicine’s patent are the key point of this article. I hope this makes it easier for Chinese medicine producer to get more information on this subject.
