    摘要: 我國都市計畫自1964年都市計畫法第一次修正後始有劃設農業區的概念與法源;自此,都市計畫法規定「都市計畫地區,得視地理形勢,使用現況或軍事安全之需要,保留農業地區或設置保護區,並限制其建築使用」。
    而由於受到都市計畫種類的差異、都市規劃觀念的轉變及都市發展的脈動…等因素之影響,農業區被賦予各種不同的功能,如都市發展預備地、緩衝綠帶、都市發展管制…等。但由於其管制依據為一通體適用之規定;加上,隨著社經活動之變遷及土地使用需求之日益複雜,農業區的定位漸形模糊,其空間現況、發展情形亦逐漸受到其他非農業使用的蠶食,再加上相關管制漸行鬆綁,以致嚴重破壞農業區之功能。另一方面,近年來有關農業區之政策與法令不斷修正與提出,但因缺乏配套的考量,使農業區的管制更形複雜與困難。
    爰此,本研究以土地使用管制與成長管理的理念為基礎,先行對於我國土地使用管制的作法與趨勢進行檢討;其次,再探討都市計畫農業區的土地使用管制制度,並分析其發展現況、管制機制與法令及相關管制政策與法規的變革,據此進行問題的發掘。並更進一步透過專家學者深度訪談進行問題的檢視,最後提出結論與建議,期能作為改善現行農業區土地使用策略缺失之參考。而本研究對於未來農業區土地使用管制所提出之建議如下:
    壹、應建立分級分類管制的農業區土地使用操作系統。
    貳、建立依農業區發展脈動與特性的動態彈性管制機制。
    参、不適於農業區設置之項目應另設分區予以管制。
    肆、加強賦予地方彈性裁量的權限,並確實暢通民眾參與的管 道,以此主動控制及引導農業區的發展並使之更為公平合理。
    The ideas and legal sources of agricultural area planning have started for Taiwan’s urban planning after the first amendment of the Urban Planning Act was promulgated in 1964. Since then, the Urban Planning Act stipulates the followings: “Agricultural regions shall be reserved or conservation regions shall be set up for urban planning depending on the geographical conditions, the current status or military security needs. Moreover, the building use shall be restricted.”
    Considering the differences in the types of urban planning, changes in the ideas of urban planning and urban developmental patterns, different functions have been designed for the agricultural regions, for example, reserved land for urban development, buffer green zones, urban development regulations, etc. Given the generality of urban development regulations, changes in socioeconomic activities and the needs of land use, the positioning of agricultural regions has become less well defined, and their spatial and developmental conditions have been set aside for non-agricultural purposes. Together with the loosening of related regulations, the functions of agricultural regions have been seriously damaged. Moreover, along with the continuous amendments and recommendations of policies and statutes in connection with agricultural regions in recent years, the control of agricultural regions has become more complicated and difficult, because of a lack of necessary facilities.
    On the basis of land use control and growth management, this study first reviews Taiwan’s land use control practices and trends, then discusses the land use control system for the urban planning of agricultural regions and analyzes its current developmental status, control mechanisms, statutes and changes in the related control polices and regulations in order to discover problems inherent in urban planning. Finally from the study of problems on the basis of depth interviews of experts and scholars, conclusions and recommendations are proposed as future reference for the improvement of the shortcomings inherent in the existing land use strategies for agricultural regions. This study has made the following recommendations for the future land use control of agricultural areas:
    1.An operating system for the graded classification and control of land use in the agricultural regions shall be formulated.
    2.A flexible dynamic control mechanism shall be formulated on the basis of the developmental patterns and features of agricultural areas.
    3.Items not applicable for the establishment of agricultural regions shall be separately controlled in sub-zones.
    4.The right of flexible policy making shall be ranted to the local government, and the channels for public participation should be guaranteed, thus actively controlling and directing the development of agricultural regions and achieving fairer and more reasonable urban planning policies.
