摘要: | 公共工程建設具有工期長、作業項目多、金額龐大、高技術水準、合約內容龐雜等特徵,其執行過程由規劃、設計、招標、施工、驗收到保固等階段,往往發生許多工程履約爭議。另一方面,政府採購主管機關辦理工程履約爭議處理,無不因處理時程冗長而且雙方無一滿意。本文透過行政院公共工程委員會採購申訴審議委員會工程履約爭議調解的類型分析,掌握工程履約爭議的主要類型,再從實證個案工程之執行過程瞭解工程執行爭議事項,及其工程履約爭議處理機制,分析其潛在的問題,期望對工程履約爭議調解機制提出預防及改進策略。
本探討以實證個案工程履約爭議調解成果為基礎,經探討發現有四。(一)對於履約爭議調解成果之看法,機關藉由調解委員專業性及功能性來決定工程履約爭議之後續處理,廠商藉由調解的快捷性,讓爭議快速解決,然美中不足之處,在許多爭議點,調解委員並未作出說明建議申請人放棄訴求之理由,此部分實有改進之處。(二)絕大部分可透過工程履約調解來解決的,皆是因不可抗力或不可歸責於乙方事由而導致增加工作之事項。(三)工程履約爭議調解問題除了調解委員選任程序面的問題,更牽涉到爭議問題發生的根源。(四)本案工程履約爭議類型多為計價爭議或漏項、計價爭議或實作實算、展延工期等之爭議,顯示勞務廠商規劃設計及技術服務專業能力不足是造成履約爭議調解事項增多之原因。
本探討計分為五章
第一章:主要在確立探討目的和探討方法與流程,以利探討進行。
第二章:對於國內公共工程產生許多工程履約爭議問題,本探討整理工程履約爭議相關文獻,並回顧檢討工程履約爭議調解制度之演變及其功能,從工程履約爭議調解類型及履約爭議調解成果之缺失,建立與探討目的(一)相呼應之探討架構,並進行論證。
第三章:現況調查蓬萊國小履約爭議調解有關公共工程履約過程中所產生的履約爭議類型,進行深入訪談,並與探討目的(二)相呼應。
第四章:藉由履約爭議調解個案之調查,分析工程履約爭議調解制度與工程執行爭議事項所衍生之履約爭議調解類型,並就深度訪談結果之問題與議題討論,提出課題與因應對策。
第五章:結論與建議,提供作為未來工程履約爭議減少及履約爭議調解改進策略之參考。
Public works were characteristic of long construction period, many operating items, high cost, high technical standards, and complicated contracts. Moreover, the complex implementation processes from planning, designing, tendering, constructing, checking on delivery to warranty stage were easily to get involved in contract disputes. On the other hand, while the Government Procurement handled contract dispute, it usually took a lot of time and no parties were satisfied. This article analyzed the Dispute Mediation cases from Complaint Review Board for Public Construction Commission, Executive Yuan to identify dispute types. Also, it investigated an empirical case (new constructing work-Penglai Elementary School) to find the dispute items on engineering implementation and mediation mechanisms. This study aimed to find out the potential problems and parties’ expectations in order to reduce the contract dispute and improve mediation mechanisms.
In this study, the dispute mediation result of constructing work (Penglai Elementary School) was reviewed and found four points. First, the view on dispute mediation is not consistence. The government’s view is to have the subsequent processing after the mediation through the professional medication committee. The builder’s view is to have the dispute resolved quickly. However, the committee only asked the builder to withdraw the appeals but didn’t explain the reasons. Second, the most of construction performance dispute resolved by mediation committee was because the disputes were resulted from natural disaster and led to workforce increase. Third, the members of mediation committee were appointed, not elected and the root causes of dispute were not identified. Last, the types of this construction contract dispute (Penglai Elementary School) were omissions, pricing/implementation cost, working period extension. It showed that designers may be lack of professional competence then it caused the increase in disputes.
This study was divided into five chapters.
Chapter 1: Establish study purposes, research methods and processes.
Chapter 2: Collect the relevant literatures about construction contract disputes from domestic public works and review the mediation system. Analyze the types of contract dispute mediation and the performance of the dispute mediation.
Chapter 3: Investigate the real case, Penglai Elementary School, to determine the dispute types of contract performance arising in the implementation process of the public works.
Chapter 4: Compare the real case mentioned above with the historical cases from literatures or from Complaint Review Board for Public Construction Commission to verify the similarity on the dispute types and mediation performance.
Chapter 5: Provide suggestions and propose strategies to reduce the construction contract disputes and improve mediation performance. |
