| 摘要: | 台灣地區目前國家公園的土地使用管制仍以土地使用分區管制為原則，而開發許可制為輔。依據內政部頒佈的國家公園法規定，將國家公園內現有的土地使用型態及資源特性劃分為:一般管制區、遊憩區、史蹟保存區、特別景觀區、生態保護區，是以資源保育的理念進行劃設分區。其中一般管制區為緩衝地帶允許土地利用型態之地區，由此可知，一般管制區在國家公園內是可開發建築的地區，但仍須兼顧資源保育。
然而，現行國家公園在土地使用分區管制中，管制標準長久施行結果仍無法考慮開發行為對環境衝擊之影響，且分區劃設原則與管制原則太過僵硬化缺乏彈性，無法因應未來自然與社會條件的變化，造成管制體繫上的一大缺失；另一方面，分區劃設經計畫審議公佈後，往往直接禁止所有權人開發或影響其開發權力，對於人民私有財產權之分配有不公平之疑慮，進而造成園內土地所有權人之抗爭。綜觀上述理由，本論文欲尋求能保障私有財產權權益以及資源保育兩者間平衡，進而提出一般管制區細分區劃設之原則。
另外，本論文將引述「陽明山國家公園計畫第三次通盤檢討先期規劃案─一般管制區(三)、(四)細分區調整劃設研究案」，以人民私有財權理論分析其座談會及相關大法官釋憲，釐清目前陽明山國家公園內一般管制區管三、管四所遭遇之課題，並將近年來管三管四區域內人民陳情案件做整理與分析，最後提出一般管制區管三、管四細分區劃設之原則提出調整建議。

Looking at the above reasons, this thesis is seeking to protect private property rights and the balance between resource conservation, and then make general control zone set up sub-divisions of principle.
